These terms govern use of the Incydental Dental Laboratory portal and the supply of custom-made dental devices by Incydental Ltd ("we", "us"). By registering a practice account or submitting an order you accept these terms.

1. Who can use the portal

The portal is for registered UK dental practices, their authorised clinicians and staff, and laboratory technicians invited by us. Each user must keep their login credentials confidential and is responsible for activity carried out on their account.

2. Custom-made devices

Devices supplied are custom-made medical devices within the meaning of the UK Medical Devices Regulations 2002 (as amended), manufactured to the written prescription of a registered dental professional. A statement of manufacture is provided with each device.

3. Prescriptions & clinical responsibility

The prescribing dentist is responsible for the clinical suitability of the design, materials, occlusion and fit, and for the quality of impressions, scans and supporting information submitted. We manufacture in accordance with the prescription supplied.

4. Turnaround & dispatch

Estimated turnaround times are indicative and depend on case complexity, scan quality and material availability. Risk in goods passes on dispatch; title passes on payment in full.

5. Pricing & payment

Pricing is per our published schedule or written quotation. Invoices are payable within 30 days of the invoice date unless otherwise agreed. We may charge interest under the Late Payment of Commercial Debts (Interest) Act 1998.

6. Remakes & warranty

We will remake or repair, free of laboratory charge, any device that fails due to a manufacturing defect within a reasonable period, where the original prescription and clinical conditions were unchanged. Remakes due to clinical changes, design changes, or impression / scan problems are chargeable.

7. Adverse incidents

Adverse incidents involving a device must be reported to us immediately at info@incydental.co.uk and to the MHRA Yellow Card scheme at yellowcard.mhra.gov.uk.

8. Liability

Nothing limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be limited by law. Subject to that, our total liability for any claim is limited to the price paid for the device giving rise to the claim. We are not liable for indirect or consequential losses.

9. Data

Personal and patient data is handled under our privacy notice.

10. Governing law

These terms are governed by the laws of England & Wales and subject to the exclusive jurisdiction of the English courts.
